Dispute Resolution Terms

How disputes are assessed and what remedies may — and may not — be available.

Please read carefully. VAGBid is a sales platform only and is not liable for the actions of buyers or sellers, or for any item transacted. No refund or remedy is issued unless an actual, proven loss is established. These terms apply to every dispute opened on the platform.

1. Our role and platform liability

VAGBid is a niche online sales platform that connects independent sellers and buyers of Volkswagen Group vehicles, parts and accessories. We are not a party to any transaction concluded between users, nor do we take possession of, store, ship, inspect or verify any item listed or sold through the platform.

We act solely as an intermediary and a venue for listings, bids, offers and messaging. Accordingly, VAGBid accepts no liability whatsoever for the conduct, actions or omissions of any buyer or seller, or for the condition, accuracy, legality, delivery or fitness of any item transacted on the platform.

Without limitation, VAGBid is not liable for: wrong, damaged, lost or late parcels and deliveries; items that are mis-sold, mis-advertised, counterfeit, faulty or not as described; non-delivery or partial delivery; payment failures or disputes between payment providers; or any direct, indirect, consequential or financial loss arising from a purchase or sale.

Any contract of sale is formed directly between the buyer and the seller. VAGBid is not a bailee, agent, guarantor, insurer or escrow provider, and nothing in these terms creates any such relationship.

2. What we will and will not do

We will make every reasonable effort to facilitate a fair outcome when a dispute is raised, including reviewing the evidence provided by both parties and applying this policy consistently and in good faith.

However, VAGBid does not guarantee any particular outcome, resolution, refund or remedy. We cannot guarantee the recovery of funds, the return of goods, or the accuracy of any decision, and we make no warranty that a dispute will be resolved in favour of either party.

Our decisions are made on a balance of the available evidence and the platform policies in force at the time. They are administrative resolutions to a platform-mediated transaction, not legal judgments, and they do not constitute legal advice, a court ruling, or a determination of legal liability.

3. Proof of loss — the burden is on the claimant

No refund, reversal, payout or remedy will be issued unless and until the party raising the dispute (the 'claimant') can demonstrate, to our reasonable satisfaction, that they have suffered an actual, quantifiable loss.

A claim is not accepted on the basis of an allegation alone. The claimant must provide clear, authentic and relevant evidence that establishes, on the balance of probabilities, that:

  • •A completed, paid transaction exists on the platform between the two named parties;
  • •The claimant upheld their own obligations under the sale (for example, the buyer paid in full and on time, or the seller dispatched the item as agreed);
  • •The other party failed to meet a specific, identifiable obligation — such as non-delivery, delivery of a materially different item, or non-payment of agreed proceeds; and
  • •The claimant has suffered an actual, measurable financial loss directly caused by that failure, not merely an inconvenience, preference or expectation.

Evidence that may support a claim includes, without limitation: tracked delivery confirmations and courier scans, dated photographs of the received item and its packaging, the original listing description and images, message thread records, payment receipts, and third-party inspection or repair reports.

Where the evidence is incomplete, contradictory, or fails to establish an actual loss, no remedy will be awarded. A disagreement over value, condition expectations, or buyer's remorse does not, by itself, constitute a recoverable loss.

4. How disputes are assessed

When a case is opened, both the complainant and the respondent are given the opportunity to submit a statement and supporting evidence. We encourage both parties to respond promptly and honestly; failure to engage may result in a decision being made on the available evidence alone.

We assess each case on its individual merits against the documented sale, the platform's listing and selling policies, and the evidence submitted. We do not assume fault — each party is treated fairly and equally, and a claim is only upheld where the evidence actually supports it.

Outcomes we may reach include: dismissal of the case where no loss is proven; a direction for the seller to issue a partial or full refund; a direction for the buyer to return an item; release or reversal of held seller proceeds; or closure with no further platform action.

5. Possible outcomes

Where an actual loss is proven, available remedies are limited to the following and are awarded at our discretion based on the evidence:

  • •Full or partial refund to the buyer, where non-delivery or a materially mis-described item is proven and the seller is at fault;
  • •Return and refund, where the buyer returns the item to the seller in the received condition and the seller refunds the sale price;
  • •Release of seller proceeds, where a buyer's claim is dismissed and the seller is owed their funds; or
  • •No remedy, where the evidence does not establish an actual loss attributable to the other party.

VAGBid does not award compensation beyond the transaction value, and does not pay damages, inconvenience costs, or third-party expenses. Any refund is limited to the amount actually transacted on the platform for the disputed item.

Where a dispute involves suspected fraud or criminal conduct, we reserve the right to suspend accounts and refer the matter to the relevant authorities, and the platform dispute process does not override any legal rights the parties may have.

6. Limits of the dispute process

The dispute resolution process is a goodwill service offered by the platform. It is voluntary, non-binding in law, and does not replace, override or limit any statutory consumer rights a buyer may have against a seller, nor any legal remedies available through the courts or a payment provider's chargeback process.

VAGBid's ability to enforce an outcome is limited to actions within the platform — for example, reversing platform fees, adjusting seller proceeds held by the platform, or suspending or removing accounts. We cannot compel a party to pay, refund, or return goods, and we hold no responsibility for ensuring compliance with a direction we issue.

Where funds have already been released to a seller, the platform cannot recover them on a buyer's behalf; the buyer's recourse in that situation lies with their payment provider or the seller directly.

By using the platform and raising a dispute, you acknowledge that VAGBid's decision is final in respect of platform-mediated actions only, and that you remain solely responsible for pursuing any legal rights you may have against the other party.

7. Acceptance

By listing an item for sale, placing a bid or offer, completing a purchase, or opening a dispute on VAGBid, you acknowledge that you have read, understood and agreed to these Dispute Resolution Terms. You accept that VAGBid is a platform provider only, holds no liability for transactions between users, and that any remedy is awarded solely at the platform's discretion and only where an actual loss has been proven.
